Netiquette “Kultur Klub Ulm”

1. Online, the same behavioral rules apply as in normal life.

When communicating online, keep in mind the behavioral rules you follow in everyday life. Insults, provocations, threats, or defamation are not tolerated. Please respect your counterpart and communicate politely and appreciatively! Express criticism in a factual manner.

2. Think of the people

Imagine the person behind the smartphone when you write messages. You are not communicating with a machine, but with real people.

3. First read, then ask.

Do you have a question about a specific matter? The community is definitely happy to help, but first look carefully at the answers in the previous discussion posts. There is a good chance that someone has already answered the question. If you write a post that is very similar to another, it only shows the other club members that you have given little attention to the conversation so far.

4. Correct and clear communication is helpful.

It is beneficial to take the time to reread your own answers before sending them. Small spelling mistakes can quickly slip in, and other members may not understand or may misunderstand them. Prevent misunderstandings by formulating posts in an understandable way and avoiding irony and double meanings.

Also, it is nice when you are addressed personally and personal messages are opened with a “Hello” and closed with a “Goodbye”—that is the amount of time that matters.

5. Respect the privacy and “personal space” of others

This applies not only online but also in personal meetings. And not only to communication, but also to uploading or sharing photos or videos taken during joint cultural visits. In particular, if third parties are visible, prior consent of the depicted individuals should be obtained.

6. Respect the time of others.

We live today in a fast‑paced world. Information and messages are sent quickly. Please consider beforehand whether you really want and can attend an event or a group offering. It would be truly unfortunate if an appointment falls apart due to poor planning—special situations and emergencies always happen, and everyone has understanding for that.

7. Forgive others’ mistakes.

Not all of our members are absolute professionals in online communication – for some it may be a new experience. So please be forgiving if not everyone is clear about the usual way of interacting in digital communication.

1. Scope of the Terms of Use

1.1 The following Terms of Use apply to participation in the "kultur klub ulm" and use of the associated app, which is provided by the City of Ulm.
1.2 Use of the app is only possible after prior registration and acceptance of the present Terms of Use.
1.3 Participation is free.

2. Purpose and Services of the Kultur Klub Ulm

2.1 The “kultur klub ulm” is a project launched by the Culture Department of the City of Ulm. It is intended to bring together culture‑interested people of all ages and backgrounds and to enable joint cultural visits and an exchange.

2.2 The City of Ulm provides participants with an app in which they can create a personal profile, create, read, and comment on posts, and exchange with other registered participants.

2.3 The services mentioned in point 2.2 are offered subject to availability. The City of Ulm assumes no responsibility for any possible delay, deletion, mis‑transmission, or storage failure in communication between participants or in connection with personally created areas.

2.4 The City of Ulm reserves the right to expand, restrict, change, or partially or fully discontinue its services at any time.

3. Registration

3.1 Only individuals aged 16 or older may register.
3.2 Each member undertakes to provide the data required for registration fully, truthfully, and in accordance with the current state, and to adjust it immediately in the event of a change.
3.3 Registration must not infringe the rights of third parties; in particular, personal data or other data of third parties may not be used without a legal basis or consent, such as names or e‑mail addresses.

4. Personal Profile

4.1 After successful registration, each member can edit their personal profile and the information therein at any time.
4.2 Each member can create, modify, or delete their own posts in the app. For changes to the personal profile the same conditions as for registration apply, see paragraph number 3.
4.3 It is possible to send messages to other participants within the used system. For this it is not necessary to disclose a personal e‑mail address or other contact details. Anyone can exchange messages with others via the messaging function in the app.

5. Access Credentials

5.1 For login, a Google account or an Apple ID is required. The username can be chosen freely, and the profile description is also optional.
5.2 Each member agrees to keep their login credentials confidential and to ensure that they are not accessible to third parties.
5.3 Each participant bears full responsibility for any action taken under their personal profile.
5.4 Each participant is required to immediately inform the cultural department of the city of Ulm about any abusive use of their personal profile as well as any violation of security regulations.

6. Obligations of Participants

6.1 Each participant is solely responsible for the content of their contributions. This also applies to photos, graphics, or other materials.

6.2 All participants agree not to publish content that violates applicable law, the present terms of use, our netiquette (see above), or good morals. This also applies to links to internet sites with such content.

6.3 Not allowed are especially

  • content whose publication constitutes a criminal offense or an administrative offense,
  • content that insults, harasses, defames, or threatens third parties, glorification or trivialization of violence, discriminatory, racist, antisemitic, volksverhetzende, sexist, or pornographic statements,
  • calls to criminal acts,
  • content that infringes third‑party rights, e.g., commercial protection rights (trademark rights, copyrights, performance rights, competition rights, etc.) or general personality rights (including the right to informational self‑determination),
  • obviously false statements,
  • any type of commercial advertising.

6.4 Forbidden entries or links will be removed from the Kultur Klub Ulm app. If third parties bring attention to the city of Ulm about forbidden content, the city of Ulm is entitled to delete these contents immediately and without prior announcement. In all cases the city of Ulm is entitled to suspend the corresponding personal profile. Further participation or a new registration is not possible in this case.

6.5 In case of a violation of paragraph 6.3 and 4, the participant is obliged to compensate the city of Ulm for any resulting damage. This includes also costs that arise through the warning of third parties.

7. Personal Data

7.1 Anyone who registers provides personal data in a standard registration form. This personal data is intended solely for private, non‑commercial purposes and is handled in accordance with applicable data protection regulations.
7.2 By registering, the participant consents to the publication of selected personal data within the protected space of the Kultur Klub Ulm app.
7.3 By registering, the participant also agrees that the data provided by them will be stored and processed by the city of Ulm for the purposes of the Kultur Klub.
7.4 The data provided by registrants will be treated confidentially and not disclosed to third parties.
7.5 The city of Ulm and its appointed service providers will take the necessary technical and organizational measures to ensure adequate protection of the provided data.
7.6 In all other cases, reference is made to the separate privacy policy of the Kultur Klub Ulm app.

8. Copyrights

8.1 Each member must ensure that the content they upload (texts, images, links, etc.) does not infringe any third‑party rights, in particular copyright. They agree to obtain prior consent for the publication of any data that depicts persons.
8.2 The participant makes the content they upload available for the purposes of the Kultur Klub free of charge.

9. Liability Disclaimers

9.1 The contributions and opinions that the participants post in the kultur klub ulm app do not reflect the opinion of the City of Ulm. The City of Ulm does not guarantee the correctness of the stated information and is not liable for the content posted by participants.

9.2 If the app contains links or hyperlinks to other websites, databases or third‑party services, the City of Ulm is not liable for their accessibility, their existence or security, nor for their contents.

9.3 The use of the app is voluntary and at one's own risk. The City of Ulm assumes no liability for damages that, for example, arise from memory failure, accidental deletion or display and data errors. The City of Ulm assumes no liability for data lost by the participant.

9.4 The participant indemnifies the City of Ulm from all claims that third parties may assert due to infringed rights. The participant must bear all costs arising in this context, e.g., court and lawyer fees. An exception occurs only if the participant is not responsible for the infringement.

9.5 If the City of Ulm has no proven intentional or gross negligence, liability claims are generally excluded:

those relating to damages of material or intellectual nature,
those caused by the use or non‑use of the provided information or by the use of erroneous and incomplete information.

10. Change of the Terms of Use

The City of Ulm reserves the right to change or supplement the current terms of use at any time. All changes will be communicated to participants in the app. If the participant objects to the change, it is equivalent to termination. In this case, the City of Ulm is entitled to delete the participant’s profile, or the participant may delete his/her own profile at his/her own discretion.

11. Termination of participation in the Kultur Klub Ulm

11.1 The terms of use apply for an indefinite period.
11.2 Participation generally ends by deleting the personal profile by the participant(s).
11.3 If the participant violates applicable law or these terms of use, the City of Ulm reserves the right to terminate without notice. In that case, the City of Ulm permanently locks the personal profile of the affected member and may delete the posted data and content.

12. Applicable law and jurisdiction

12.1 The law of the Federal Republic of Germany applies.
12.2 The contractual language is German.
12.3 The place of jurisdiction for all disputes concerning the use of the Kultur Klub Ulm app is Ulm.

13. Final provisions (severability clause)

13.1 If any provision of these terms of use is ineffective, it shall be replaced by a valid provision that corresponds to the purpose and intent.
13.2 The validity of the remaining provisions remains unaffected by the invalidity of individual provisions.
